1. Overview

The website lovms.com (the "Site") is operated by ONEFIRELED LLC, a Colorado limited liability company doing business as LOVMS ("LOVMS", "we", "us" or "our"). By visiting the Site or buying from us, you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the Site.

2. Eligibility

You must be at least the age of majority in your state of residence to place an order. You agree to give us accurate, complete account and purchase information.

3. Products and descriptions

We try to describe and display our products accurately. Our jewelry is made of 925 sterling silver, some with gold plating, and set with lab-created moissanite. Colors, sizes and finishes may vary slightly from images because of screen settings. We don't guarantee that product descriptions or other content are entirely error-free.

4. Pricing and availability

Prices are listed in US dollars. For US orders, prices include import duties. Prices and availability may change without notice. If a product is listed at an incorrect price because of an error, we may cancel orders for that product and refund any payment.

5. Orders and payment

Placing an order is an offer to buy. We may accept, limit or cancel any order, for example in cases of suspected fraud, pricing errors or stock issues. If we cancel an order after payment, we'll issue a full refund. Payments are processed by Shopify and its payment partners.

6. Shipping, returns and refunds

Shipping, returns and refunds are governed by our Shipping Policy and Refund Policy, which are part of these Terms. Risk of loss passes to you on delivery.

7. Intellectual property

All Site content, including text, images, logos and designs, belongs to LOVMS or its licensors and is protected by intellectual property laws. You may not copy, reproduce or use it commercially without our written permission.

8. Prohibited uses

You may not use the Site for unlawful purposes. You may not interfere with its security or operation, upload malicious code, scrape it, or infringe the rights of others.

9. Third-party links and services

The Site may link to third-party sites or use third-party tools. We are not responsible for their content or practices.

10. Disclaimer of warranties

Except as required by law or as stated in our Refund Policy, the Site and products are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose.

11. Limitation of liability

To the fullest extent permitted by law, LOVMS and its members, employees and partners are not liable for indirect, incidental, special or consequential damages arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product involved.

You agree to indemnify and hold LOVMS harmless from claims that arise from your breach of these Terms or your misuse of the Site.

Your use of the Site is also governed by our Privacy Policy.

14. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Boulder County, Colorado, unless applicable law requires otherwise.
